Note: The alleged victim of
an assault and battery has no control over whether the charge is
sworn out by the officer in front of a magistrate. Further, the
alleged victim has no right to "drop" the charge before trial or at
trial. In fact, charges are almost never "dropped" prior to Court
and only rarely "dropped" by a prosecutor at trial. Also, failure by
the alleged victim to appear at trial will not result in automatic
dismissal of the charge. In almost all cases, the prosecution will
be granted a continuance and another trial date will be set. And if
the alleged victim had been provided a summons, he or she may be
prosecuted for failure to appear.
Assault and
Battery
and Domestic Assault and Battery are serious crimes.
Usually a misdemeanor, it is punishable by up to 12 months in
jail and up to a $2,500 fine, either or both. Persons
convicted of Domestic Assault and Battery also lose the right to
possess firearms under federal law.
